Shall the Charter of the County of Alameda be amended to provide that qualified persons with severe disabilities be exempted from civil service examination requirements for certain entry level positions in County service, with such persons acquiring regular civil service status after one year of satisfactory service?

Section 23720 of the Government Code and Section 9102 of the Elections Code provide that a County Charter may be amended by submitting the proposed measure to the voters.

If a majority of the qualified electors voting on this measure vote for approval, the Alameda County Charter will be amended to allow certain identified entry-level civil service classifications for employment with Alameda County to be designated as unclassified and to be filled by a qualified person with a severe disability. Pursuant to the proposed amendment, applicants to these unclassified positions would include individuals with a visual, hearing, speech, orthopedic, mental, or developmental disability; persons recovering from substance abuse; and those with disabilities that impair one or more major life functions such as walking, seeing, or hearing. Persons applying for these designated unclassified positions would first be certfied as employable by the California State Department of Rehabilitation. These applicants then would not participate in a civil service examination process, but would be interviewed and chosen by managers or supervisors in a department who had designated certain entry-level positions as unclassified. After a year of satisfactory work performance, the unclassified employee would become a tenured civil service employee of Alameda County. Employees not performing satisfactorily could be separated at any time during the twelve-month evaluation period under the provisions of the amendment and not become civil service employees of the County.

If a majority of the qualified electors voting on this measure do not vote for approval, the measure will fail and the Alameda County Charter will not be amended.

Arguments For Measure B Arguments Against Measure B
Measure B will allow the County of Alameda to conform to already existing Federal and State employment practices in hiring persons with disabilities. It gives County management the authority to appoint qualified persons with severe disabilities to temporary entry-level positions for a maximum of one year. This would enable the person with the disability to gain essential experience and determine the most effective ways to work. If successful they will acquire regular civil service status in the position.

Almost 70% of working age adults with disabilities are unemployed and many receive welfare assistance. If given the chance, most persons with disabilities would prefer to work and support themselves. As demonstrated repeatedly by Federal, State, other County and private sector programs, people with severe disabilities can be productive and valuable employees. Under the existing competitive examination system, the employment opportunities for people with severe disabilities have been limited. A "Yes" vote on Measure B gives the mechanism for opening up more employment opportunities to people with disabilities that have been certified as "severe" such as blindness, deafness, developmental disability and paraplegia.

For years, other counties and many private industry employers have offered special hiring options for qualified workers with disabilities and Alameda County should do the same. We should support giving our citizens with disabilities the opportunity to fully participate in and contribute to our community.

Text for Measure B
Alameda County Charter - Section 35.2. The unclassified service shall include entry level positions designated by an appointing officer with approval of the civil service commission for persons who meet minimum qualifications and are certified as persons with severe disabilities. Notwithstanding any other provisions of the Charter, persons appointed to such positions under this subsection, and whose job performance is certified as satisfactory by their appointing officer, and who remain in said position for one year, shall acquire civil service status. The civil service commission shall adopt rules and regulations to enforce and implement this subsection which shall include performance evaluation requirements, definitions of and standards for the certification of people with severe disabilities.
