To protect essential public transportation services provided by AC Transit, including bus services for school children, seniors and people with disabilities, ensure the safety and security of transit passengers, help reduce traffic congestion on local streets and freeways, and reduce air pollution, shall the Alameda Contra-Costa Transit District be authorized to levy annually for five years only a tax of $24 per parcel, and appoint an independent fiscal oversight committee of community representatives?

Impartial Analysis from The County Counsel
If approved by two- thirds of the voters voting thereon, Measure AA would authorize the Alameda- Contra Costa Transit District ( "the District ") to levy a special tax in an amount not to exceed $ 24 per year for five years. The tax would begin on July 1, 2003 and terminate on June 30, 2008. This special tax would be assessed against the owner( s) of each parcel of taxable land in that portion of the District identified as Special Transit District 1 for the purpose of funding the operation and maintenance of bus service within that district.

A special transit district organized under the provisions of the California Public Utilities Code, following notice and public hearings, has the authority to levy special taxes upon approval by two- thirds of the votes cast on the special tax proposal pursuant to Section 4 of Article XIIIA and Article XIIIC of the California Constitution and sections 50075- 77, and 53722 of the California Government Code and section 25892.1 of the California Public Utilities Code.

If two- thirds of the qualified electors voting on this measure vote "Yes ", $ 24 per year per taxable parcel (any unit of land in the District which now receives a separate tax bill from the Alameda County or Contra Costa 's Assessor 's Offices) would be collected by the Alameda County or Contra Costa County Tax Collectors at the same time and manner as and along with the general property taxes. Owners of undeveloped land, developed but vacant land and tax- exempt land would not be subject to the tax.

The District would be authorized to use its proceeds to offset reductions in services provided by AC Transit in District 1. The District's Chief Financial Officer would be required to file a report with the District's Board of Directors every year disclosing how the moneys collected have been used. In addition, a fiscal oversight committee of community representatives would also report to the Board of Directors annually on the use of the tax proceeds.

If less than two-thirds of the qualified electors vote for approval of this measure, it will fail and the Alameda- Contra Costa Transit District will not be authorized to levy this proposed special tax in District 1 of Alameda and Contra Costa counties.

Arguments For Measure AA Arguments Against Measure AA
AC Transit needs your help to maintain essential bus services for students, seniors, people with disabilities, commuters, and other riders.

Safe, reliable public transit means safer, healthier communities. Good public transit means that people have mobility options for work, school, shopping and other daily activities.

Specifically Measure AA will:

•Protect bus service for school children
•Help preserve mobility for senior citizens and people with disabilities
•Continue the bus monitor program that ensures passenger safety and security on local buses

Measure AA will provide local funding for a 5-year period to limit severe cutbacks in bus service. It will cost property owners only $ 2 a month and is deductible on state and federal taxes.

An independent community oversight committee will monitor expenditures with an annual audit to ensure that all Measure AA funds are spent properly. In recent years AC Transit has become a more efficient organization. Unfortunately, this remarkable improvement is overshadowed by deep cutbacks in local, state and federal funding for transit combined with costly new unfunded mandates.

While this ballot measure cannot make up for the funding cuts and new requirements, it can help provide bus riders with safe, reliable transportation and provide all of us with safer neighborhoods. Measure AA funds could protect our air by preventing two million or more car trips annually.

AC Transit has won recognition and national awards for its innovative, reliable service. A quality bus system prevents gridlock on our roads, reduces air pollution and is an essential service to those who depend on it.

Despite the economy, AC Transit has taken extraordinary measures this past year to avoid service cuts. AC Transit has tried to do its part #and now we ask for your help to pass Measure AA.

Please vote yes on Measure AA.
