Issue 1 Referendum on Substitute Senate Bill 16

Shall Substitute Senate Bill No. 16, be approved? (Please vote "Yes" if you are in favor of the bill. Please vote "No" if you are not in favor of the bill. The bill is explained below.)

Substitute Senate Bill No. 16 would make certain changes to state law that regulates the operation of sexually oriented businesses and adult entertainment establishments. These changes include:

Requiring the State of Ohio to compensate local governments (townships, cities and villages) who enforce local laws regulating adult entertainment establishments when those local laws have been adopted with the guidance of the Ohio Attorney General and when those laws are found unconstitutional or invalid by a court, with certain exceptions for payment of such compensation,

Preempting local laws that are found by a court to be in conflict with the proposed state law regulating adult entertainment establishments,

Prohibiting sexually oriented businesses from being open for business between midnight and 6 a.m., except that sexually oriented businesses with a liquor permit may remain open until the hours specified in the permit if they do not conduct, offer, or allow, sexually oriented entertainment activity in which the performers appear nude,

Prohibiting customers and employees of sexually oriented businesses who are not immediate family members from touching each other while on the premises of that business and while the employee is nude or seminude, and

Creating misdemeanor criminal offenses relating to hours of operation and for customers and employees who violate the no touch provisions of the law, setting the penalty at a fourth degree misdemeanor, except when the touching is in specified anatomical areas, in which case, the penalty is a first degree misdemeanor.

If Substitute Senate Bill No. 16 is approved, it shall become law.

Resolution of the Board of County Commissioners of Hamilton County Ohio, increasing the rate of levy of the existing sales tax pursuant to the provisions of RC 5739.021 for a fifteen year period (one half of one percent for eight years followed by one quarter of one percent for seven years) to be used for the purpose of SUPPORTING CRIMINAL AND ADMINISTRATIVE JUSTICE SERVICES IN THE COUNTY, INCLUDING: PUBLIC SAFETY AND JUDICIAL ADMINISTRATION MEASURES TO REDUCE JAIL OVERCROWING, CRIME PREVENTION MEASURES, ADULT AND JUVENILE REHABILITATION MEASURES, OPERATION OF NEW DETENTION FACILITIES, AND TO ACQUIRE LAND AND OTHER FACILITIES BY PURCHASE OR LEASE FOR SAID PURPOSES.

Issue 28 Mental Health Services Levy (Renewal and Increase) -- Hamilton County

A renewal of 2.74 mills and an increase of 0.25 mill to constitute a tax for the benefit of the County of Hamilton, Ohio, for the purpose of PROVIDING FUNDS FOR THE ALCOHOL, DRUG ADDICTION AND MENTAL HEALTH PROGRAMS AND THE ACQUISITION, CONSTRUCTION, RENOVATION, FINANCING, MAINTENANCE AND OPERATION OF MENTAL HEALTH FACILITIES at a rate not exceeding two and 99 hundredths (2.99) mills for each one dollar of valuation, which amounts to twenty-nine nine-tenths cents ($0.299) for each one hundred dollars of valuation, for five (5) years, commencing in 2007, first due in calendar year 2008.

A majority affirmative vote is necessary for passage.

A renewal of 1.16 mills and an increase of 0.13 mill to constitute a tax for the benefit of the County of Hamilton, Ohio, for the purpose of PROVIDING OR MAINTAINING A SYSTEM OF HOME CARE THROUGH THE COUNCIL ON AGING OR OTHER SERVICE PROVIDER(S) FOR ELDERLY RESIDENTS, INCLUDING BUT NOT LIMITED TO: HOUSEKEEPING, PERSONAL CARE, RESPITE SERVICES (FOR CAREGIVERS), HOME REPAIR/MAINTENANCE, MEDICAL TRANSPORTATION, ADULT DAY CARE, HOME DELIVERED MEALS, CHORE SERVICES, LEGAL COUNSELING, ADULT PROTECTIVE SERVICES AND DURABLE MEDICAL EQUIPMENT at a rate not exceeding one and twenty nine hundredths (1.29) mills for each one dollar of valuation, which amounts to twelve and nine tenths cents ($0.129) for each one hundred dollars of valuation, for five (5) years, commencing in 2007, first due in calendar year 2008.

A majority affirmative vote is necessary for passage.
