Laws are made by the legislature. Laws are interpreted and applied by judges. These two separate and distinct functions should never mix. The legislature is the branch of government that the U.S. and Ohio Constitution delegate to make the laws of our land. The job of a judge is to apply the law to a set of facts as the legislature intended. The legislature is the voice of the people. If the judges make their own laws, the voices of the people are not heard. Judicial activism destroys the faith in our government because it leaves citizens with no certainty in what rules to follow. As a judge, I strictly adhere to judicial precedent and enforce the Constitution and laws of this State. |
