I have always believed in honesty, fairness and equality in the judicial system. Although I enjoy being an attorney, I always evaluate all positions that I think all parties have to determine how best to proceed. The problem with the judicial system right now is that initially all parties believe that they are right, so that is why one sues the other. I believe that the courts should be more available to the public, and that the procedures to get into court become even more simplified than they are now. I believe in a "super small claims court", whereby litigants agree to have their cases heard in two hours or less, waive all formal discovery rules and allow the case to be heard by a judge, commissioner, or other "hearing officer", sort of like a referee. I also have the idea of a daily jury system whereby a selection of people to hear many cases in one day, in the new super small claims court, so that the administration of justice can go much faster. This will work on cases where the facts are not so complicated, there are mostly two parties and not a lot of witnesses or other plaintiffs and defendants, and that the cases can be heard in less than 2 hours. I proposed this while a judge pro tem. I thought for cases of $25,000 or less, this would be a very good program. |
